These public sector procurement frameworks are designed to bring together government and publicly funded bodies such as Councils, Housing Associations, NHS Trusts and Universities and Colleges, and private sector suppliers.


According to CCS, which has a key construction framework:

"Over £31 billion of public sector spend (all spend types) was channelled through CCS agreements" (Crown Commercial Services: July 2023)


With £700 million alone via their new agreement with NHS England via the Construction Works and Associated Services 2 / ProCure 23 agreement, for example.

When public sector bodies work with contractors they need to ensure procurement compliance, as they are spending tax payers money! This means working with good, high-performing contractors who share their ethics and commitment to the wider community and social value. To do this fairly, they need to follow specific procurement rules and achieve value for money. This can take time, create risk and not always be the best of use of resources, if other public sector buyers have exactly the same needs. Construction framework agreements are their solution to working with pre-approved and vetted contractors, as the procurement has already taken place (getting onto the framework).

There are of course pros and cons to framework agreements, however, for most businesses, especially for those who work in the public sector or want to win government tenders, they really are a key tool.

Tendering for construction frameworks

A framework application can be a very similar to a typical construction bid for a contract, however, by its nature the questions are more general and not project focused. There are now thousands of framework agreements across the public sector. Frameworks and DPS have been created to allow public sector suppliers and buyers to work together more easily. However, this sheer volume can make it difficult for construction businesses when tendering for frameworks. Which construction framework should I be? Which do my existing public sector clients prefer to use? Does the construction framework generate a lot of business an opportunity to tender?

Procurement Act 2023 - impact on construction frameworks

The Procurement Act 2023 is the most substantial change impacting construction frameworks in recent years. Traditionally, public sector framework agreements have been open for a 6 - 8 week period, which is your chance to bid. They have then been closed to new contractors, which in turn leads to the creation of more frameworks to access new suppliers. DPS (Dynamic Purchasing Systems) offered chances for quick wins, but as part of the Procurement Act 2023, framework agreements will change. Giving construction businesses more opportunities to access existing frameworks.


Framework duration and reopening

  1. Frameworks can last up to 8 years
  2. Must reopen at least once in the first 3 years and again within 5 years
  3. Buyers should consider reopening more often based on market needs, but balance this with administrative effort
  4. Contract notices must state if there is a supplier limit or if it is unlimited
  5. Notices should also indicate if suppliers need to reapply when the framework reopens
  6. Existing framework contractors may have to resubmit their bid to remain on the framework, when its reopened.


Transition from DPS to Dynamic Markets:

  1. Dynamic Markets will replace the current Dynamic Purchasing Systems
  2. Suppliers can join at any time
  3. Buyers must publish a Dynamic Market Notice with detailed information to help suppliers decide if they want to join
  4. Buyers must clarify whether the Dynamic Market is open-ended or has a specific end date
  5. Suppliers might have to pay a fee to join the Dynamic Market, which will be a fixed percentage of the contract's value.

Procurement Act 2023 and direct awards

Direct awards have crucial for many construction contractors who are approved on public sector framework agreements. Under the Procurement Act 2023, direct awards can be made in certain cases within frameworks and dynamic markets. For frameworks, direct awards are allowed if the framework's terms support it, such as when there is only one supplier or pre-agreed pricing. In dynamic markets, direct awards are permissible if no other suppliers can meet the requirements or in urgent situations.

Additionally, contracting authorities need to publish a 'transparency notice' before directly awarding a contract and this notice must state the intention to award directly and provide essential contract details. Chapter 3 and 4 provide full details.
